Terms of Service

1. Acceptance of Terms

By creating an account or using ScholarMark at www.scholarmark.co.ke, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

ScholarMark is a global platform serving users in multiple countries. These terms apply to all users worldwide. Where local consumer protection laws in your jurisdiction provide additional rights, those rights are not affected by these terms.

2. Description of Service

ScholarMark provides two core services:

  • Integrity Scan, AI detection and plagiarism scanning of uploaded documents, powered by ZeroGPT. Results include a percentage score, sentence-level analysis, and a downloadable PDF report.
  • Document Review, structured academic feedback on uploaded documents covering structure, grammar, argument strength, citation quality, and brief alignment, with scores and specific recommendations.

Both services are paid on a per-use basis via Paystack. Prices are displayed in USD and GBP equivalents for reference and charged in KES at checkout.

3. Account Registration

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 13 years old to use ScholarMark (16 in the EU/UK).
  • You are responsible for all activity that occurs under your account.

4. Payments and Refunds

All payments are processed by Paystack. By making a payment you also agree to Paystack's terms of service.

  • Payments are charged per scan or per review at the price shown at checkout.
  • All prices are charged in Kenyan Shillings (KES). USD and GBP equivalents shown are indicative only and subject to exchange rate fluctuations.
  • All sales are generally final once a scan or review has been processed, as the service is delivered digitally and immediately.
  • If a technical failure on our part prevents delivery of a completed report, we will provide a re-run at no charge or issue a refund. Contact us at crisndunguw@gmail.com within 7 days of the failed transaction.
  • EU and UK consumers have statutory rights regarding refunds for digital services under applicable law. Nothing in these terms limits those statutory rights.

5. Acceptable Use

You agree not to use ScholarMark to:

  • Submit documents containing illegal content, malware, or exploits.
  • Attempt to reverse-engineer, scrape, or abuse the platform or its APIs.
  • Use the platform to facilitate academic fraud, for example, submitting another person's work as your own, or manipulating results to evade detection.
  • Impersonate another person or entity.
  • Attempt to gain unauthorised access to other users' accounts or data.
  • Violate any applicable local, national, or international law or regulation.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

You retain full ownership of all documents you upload to ScholarMark. By uploading a document, you grant ScholarMark a limited, non-exclusive licence to process the document solely for the purpose of delivering the requested service. This licence ends when you delete the document or close your account.

ScholarMark owns all intellectual property in the platform, including the interface, report templates, and underlying code. You may not copy, reproduce, or distribute any part of the platform without our written consent.

7. Accuracy of Results

AI detection and plagiarism scanning are probabilistic technologies. ScholarMark's results are indicative and intended as a tool to assist human judgment, they are not definitive findings of academic misconduct.

ScholarMark results should not be used as the sole basis for academic decisions, disciplinary action, or any adverse finding against a student. False positives and false negatives are possible. We strongly recommend involving qualified human judgment and following your institution's academic integrity policies before taking any action based on our results.

8. Limitation of Liability

To the maximum extent permitted by applicable law, ScholarMark shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of data, academic penalties, or reputational harm.

Our total liability to you for any claim arising from your use of ScholarMark shall not exceed the amount you paid to ScholarMark in the 3 months preceding the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

9. Service Availability

We aim to keep ScholarMark available at all times but do not guarantee uninterrupted access. We may perform maintenance or experience outages beyond our control. We will endeavour to provide advance notice of planned maintenance where possible.

10. Termination

You may delete your account at any time from your account settings. Upon deletion, all your documents, history, and personal data will be permanently removed within 30 days.

We may terminate or suspend your account if you violate these terms. We will provide notice where reasonably practicable, except where immediate action is required to protect the security of the platform or other users.

11. Governing Law and Disputes

These terms are governed by the laws of Kenya, where ScholarMark is incorporated. However, as a platform serving users globally, we recognise that users in other jurisdictions may have additional rights under their local laws.

EU users: You may also benefit from the mandatory consumer protection provisions of the law of your country of residence, and you may bring legal proceedings in the courts of your country.

UK users: Your statutory rights under UK consumer law apply and are not affected by these terms.

We encourage users to contact us first to resolve any disputes before initiating legal proceedings. We are committed to resolving issues quickly and fairly.
